CITY OF EVERETT SPECIAL PROVISIONS <br /> the Contractor must submit to the Engineer. (This definition replaces the definition in <br /> WSDOT 1-01.3 for Working Drawings.) <br /> Supplement Section 1-01.3 by adding the following: <br /> All references in the Standard Specifications to the terms "State", "Department of <br /> Transportation", "Washington State Transportation Commission", "Commission", <br /> "Secretary of Transportation", "Secretary", "Headquarters", and "State Treasurer" shall <br /> be revised to read "City." <br /> All references to the terms "State" or "state" shall be revised to read "City" unless the <br /> reference is to an administrative agency of the State of Washington, a State statute or <br /> regulation, or the context reasonably indicates otherwise. <br /> All references to "State Materials Laboratory" shall be revised to read "City designated <br /> ' location." <br /> Additive: A supplemental unit of work or group of bid items, identified separately in <br /> the Proposal, that may, at the discretion of the City, be awarded in addition to the base <br /> ' Bid. <br /> Alternative or Alternate: One of two or more units of Work or groups of bid items, <br /> identified separately in the Proposal, from which the City may make a choice between <br /> different methods or material of construction for performing the same Work. <br /> Award Date: The date of the formal action by the Everett City Council to accept the <br /> lowest responsible and responsive Bidder for the Work. <br /> ' Bid Documents: The component parts of the proposed Contract which may include, <br /> but are not limited to, the Proposal Form, the proposed Contract Provisions, the <br /> proposed Contract Plans, and Addenda. (This definition replaces the definition in <br /> WSDOT 1-01.3 for Bid Documents.) <br /> Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br /> ' Business Day: A business day is any day from Monday through Friday except <br /> holidays as listed in 1-08.5. <br /> Change Order: Reference to Change Order shall include all rights of the City and <br /> e Contractor under 1-04.4 CHANGES. Agreed Change Orders shall be in the form <br /> attached as Appendix C. Unilateral Change Orders shall be in the form attached as <br /> Appendix C. <br /> ' Contract Claim: Any request by the Contractor for additional time or money resulting <br /> in adjustment of Contract Sum or Contract Time irrespective of the cause or reason for <br /> the request. Contract Claims include, but are not limited to, requests by the Contractor <br /> for additional time or money due to Extra Work, inefficiencies, Delays, interferences, <br /> and problems with the design. Contract Claim includes, but is not limited to, claims or <br /> requests by Subcontractors for extensions of Contract Time, adjustment of Contract <br /> Sum, additional compensation that the Contractor attempts to pass through or assert <br /> against the City, or claims against the City arising out of a third party's claim against <br /> the Contractor. <br /> Contract Documents: See definition for"Contract." <br /> Contract Execution Date: The date the City of Everett officially binds the Contractor <br /> to the Contract. <br /> Contract Sum: The price in dollars stated in the Contract to be paid by the City to the <br /> Contractor for the Work described in the Contract Documents, as modified by Change <br /> Orders. <br /> 111Contract Time: The period of time established by the terms and conditions of the <br /> Contract within which the Work must be physically completed. <br /> Watermain Replacement "T" Division 1 —GENERAL REQUIREMENTS October 10, 2018 <br /> WO No—UP3684 SP—43 <br />
