I At any time prior to the scheduled closing time for receipt of proposals, any bidder may withdraw I his proposal, in accordance with Section 00100, Part 5.1.6 "Withdrawal of Bids", of the Specifications. The withdrawal request shall be made personally or by written request and/or telegraphic and confirmed written request. If withdrawal is made personally,proper receipt shall be given therefore. After the scheduled closing time for the receipt of proposals, or before award of contract, no bidder will be permitted to withdraw his proposal unless said award is delayed for a period111 exceeding forty-five (45) days. Any bids received after the scheduled closing for receipt of bids shall be returned to the bidder unopened. 111 1.6 Security to be Furnished by Each Bidder In accordance with Section 00100, Part 5.5.3 "Bid Guaranty", of the Specifications a certified check, bank cashier's check or bid bond made payable to the City of Everett for an amount equal to at least five percent (5%) of the total bid, shall accompany each proposal as evidence of good faith and as a guarantee that if awarded the contract the bidder will execute the contract and give bond as required by the Proposal. Should the successful bidder fail to enter into a contract and furnish a satisfactory performance bond within twenty (20) calendar days after the award date the certified check, cashier's check or bid bond shall be forfeited as liquidated damages. Bid deposits in cash will not be accepted. 1.7 Bidders Information The `Bidders Information Statement" supplied in the contract documents shall be filled out in detail, signed and submitted with the bid. 1.8 Execution of Contract In accordance with Section 00100, Part 10.10.3 "Acceptance of Bid", of the Specifications 111 (except as noted in Item 3 below),the bidder winning the award of this project will be required to submit the following documents to the City within twenty (20) calendar days after the award date. 1. Two (2)executed copies of the contract. 2. Contract bond or equivalent performance bond per Section 00710, Part 15.2 "Bonds", of the Specifications. 3. Certificate of Insurance and additional insured endorsement, Section 00710, Part 15.3 "Insurance", of the Specifications. 1.9 Time of Completion The Contractor shall physically complete the work within 89 calendar days from the date of written notice to proceed in accordance with Section 1-08.5 of the Specifications. All preload/surcharge work shall be completed as outlined in Section 01313. 1.10 Wage Rates The prevailing rate of wages to be paid all workmen, laborers or mechanics employed in the performance of any part of this contract shall be in accordance with Section 00710, Part 7.1 EVERETT RIVERFRONT SURCHARGE INSTRUCTIONS TO BIDDERS 1 PHASE 3 WO No. RD 3316-32 00200-2
