I
1.2. CONTRACT DOCUMENTS
The complete Contract includes:
Federal requirements that apply to this Contract and Project; I
Supplemental agreements between Owner and Contractor, if any, subsequent to the City's execution
of the Contract;
Addenda;
The Contract;
Specifications, including, but not limited to, these General Conditions and Divisions 2 through 9 of the
Washington State Department of Transportation Standard Specifications.
Supplementary Conditions
Contract plans and drawings;
Change orders;
City of Everett standard plans in effect as of the date bids are opened; I
Instructions to or Information for Bidders;
Bidder's completed proposal form; and
Certifications and affidavits as required by this Contract and by law;
These parts complement each other in describing a complete Work. Any requirement in one part binds as
if stated in all parts. The Contractor shall provide any work or materials clearly implied in the Contract
even if the Contract does not mention it specifically. Any inconsistency in the parts of the Contract shall
be referred to the Owner's Representative attention for a determination of the intended requirements.
. The Work required in one part must be furnished even if not mentioned in other parts of the Contract. If
any part of the Contract requires Work that does not include a description for how the Work is to be
performed, the Work shall be performed in accordance with standard trade practice(s). For purposes of
the Contract, a standard trade practice is one having such regularity of observance in the trade as to
justify an expectation that the Contractor will follow or observe the practice in performing the Work. In
111
case of any ambiguity, disagreement or Dispute over interpreting the Contract, the Owner's
Representative's decision will be final as provided in the General Conditions.
Approved Shop Drawings, other Contractor's submittals, and the reports and drawings of subsurface and
physical conditions are not Contract Documents.
2. SPECIFICATIONS AND DRAWINGS
2.1. INTERPRETATION OF SPECIFICATIONS AND DRAWINGS
The Specifications and drawings are intended to be explanatory and supportive of each other. Work 111
specified on the drawings and not in the Specifications, or vice versa, shall be executed as if specified in
both. In the event the Work to be done or matters relative thereto are not sufficiently detailed or
explained in the Contract Documents, the Contractor shall immediately ask the Owner's Representative
for further explanation and shall comply with such explanation. In the event of doubt or question arising
respecting the true meaning of the Specifications or drawings, Contractor shall refer to the Owner's
Representative for his or her decision.
The Specifications may vary in form, format and style. Some specification sections are written in varying
degrees of streamlined or declarative style and some sections may be relatively narrative by comparison.
Omissions of such words and phrases as"the Contractor shall,""in conformity with,""as shown,"or"as
specified"are intentional in streamlined sections. Omitted words and phrases shall be supplied by
inference. Similar types of provisions may appear in various parts of a section or articles within a part
EVERETT RIVERFRONT SURCHARGE GENERAL CONDITIONS
PHASE 3
00710-4
1
