A <br />NPDES (National Pollutant Discharge Elimination System) permit, administered <br />by Washington Slate's Department of Ecology, may be required for this site. <br />3. The placement and design of structures on shoreline sites shall be done in a manner <br />which is least detrimental to shoreline views and vistas. In certain instances this may <br />be accomplished by orienting the length axis of the building and/or operation parallel to <br />the view line. (SMP General Regulation �/4) <br />The length axis of the building will run perpendicular to the river. The <br />maximum height of the building will be under 35 feet in height. <br />4. Shoreline sites shall have a landscaping plan which is in scale and harmony with <br />proposed structures and serves to provide some screening and buffering of the actrvrties <br />where this is appropriate. (SMP General Regulation N6) <br />See language under Specific Regulation 113. <br />5. Where feasible, and where provision for maintenance is established, new shoreline <br />development shall provide pedestrian access to the shoreline. This access shall be <br />designed so as to prevent interference with the conduct of the principal activity at the <br />site. In those instances where public access is provided, it shall be perntanently <br />guaranteecl to the public, through dedication or easement. (SMP General Regulation #8) <br />It is unfeasible to provide pedestrian access to the shoreline at this location since <br />the proposed development is a water-dependent use. See language under <br />Specific Regulation �2. <br />6. Construction or substantial progress toward construction of a project must be <br />undertaken within 2 years after final approval of the permit, and completed within five <br />years. (SMP General Regulation //9 as modified by WAC 173-27-090(1)) <br />This construction time limit will be listed as a requirement. <br />Specific Regulations <br />In addition, the proposed project must comply with the following applicable specific <br />regulations as a"Commercial Development" of the City of Everett Shoreline Master <br />Program (Uncodified) (see Exhibit 5) <br />l. Prioriry shall be given to commercial development in areas presendy served by <br />roads and utility. <br />The area is served by Railway Avenue. There is no sanitary sewer available on <br />site. A new sanitary sewer main will be required to be constructed along <br />Raihvay Avenue to service this properry. Any other means of sewage disposal <br />will require approval by the City of Everett Public Works Director and the <br />Snohomish Health District. Potential sewer solutions might include; Forming <br />an LID to facilitate funding construction; Establishing a Latecomers Agreement <br />to possibly recoup some construction wsts; Contributing a pro-rata share of the <br />� <br />
