The commercial development is on private land. <br />Zoning Code Regulations <br />A. Floodplain Regulations <br />The site is designated M-2 UFFD, Heavy Manufacturing Urban Flood Fringe <br />District. "Shipping, marine", "warehouse", and "offices" are listed as permitted uses <br />in the M-2 zone. The Flood Fringe Overlay District requires the following <br />development standards: <br />1. The first floor of structures and outdoor storage area shall be two feet above the <br />regulatory flood protection elevation. <br />2. The elevation of the site shall be two feet above the regulatory flood protection <br />elevation for a distance of fifteen feet beyond any structure in any direction. <br />3. All parking areas and driveways shall be no lower than one foot below the <br />regulatory flood protection elevation. <br />4. Compliance with Federal Regulations Tide 44 CFR Part 60.3 and Subsection <br />30.050 of this Ordinance is required. Subsection 30.050 requires the following: <br />i.All new construction and substantial improvements shall be anchored to <br />prevent tloatation, collapse, or lateral movement of the struc[ure. <br />ii.All new construction and substantial improvements shall be constructed with <br />materials and utiliry equipment resistant to flood damage. <br />iii.All new construction and substantial improvements shall be constructed using <br />methods and practices that minimize flood damage. <br />iv.Electrical, heating, ventilation, plumbing, and air-conditioning equipment <br />and other service facilities shall be designed and/or elevated so as to prevent <br />water from entering or accumulating within the components during conditions <br />of flooding. <br />The floor of the structure must be at a minimum of 14 feet above the mean sea <br />level to meet the Flood Fringe District minimum requirement of two feet above <br />the base flood elevation of 12 feet. <br />B. Environmentally Sensitive Area <br />The site is subject to Subsection 37.130.A of d�e Ciry of F.verett Zoning Caie which <br />categorizes the Snohomish River as a Category I stream. Subsection 37.140.A.1 <br />requires a standard 100-foot buffer from Category I streams. However, Subsection <br />37.150.B.1.b allo�vs a portion of the buffer to be eliminated if necessary to provide <br />access to deepwater for a water dependent use or to expand an existing �vater-dependent <br />■1 <br />
