Within 14 calendar days after the date of each statement, <br /> the Contractor shall file a written protest of any alleged discrepancies in it. To be <br /> considered by the Engineer, the protest shall be in sufficient detail to enable the <br /> Engineer to ascertain the basis and amount of time disputed. By not filing such <br /> I detailed protest in that period, the Contractor shall be deemed as having accepted <br /> the statement as correct. If the Contractor elects to work ten hours a day and four <br /> days a week (a 4-10 schedule) and the fifth day of the week in which a 4-10 shift is <br /> I worked would ordinarily be charged as a working day then the fifth day of that week <br /> will be charged as a working day whether or not the Contractor works on that day. <br /> The Engineer will give the Contractor written notice of the Physical Completion Date <br /> I for all Work the Contract requires. That date shall constitute the Physical <br /> Completion Date of the Contract, but shall not imply the City's acceptance of the <br /> Work or the Contract. <br /> I The Engineer will give the Contractor written notice of the Completion Date of the <br /> Contract after all the Contractor's obligations under the Contract have been <br /> performed by the Contractor. The following events must occur before the <br /> Completion Date can be established: <br /> II1. The physical Work on the project must be complete; and <br /> 2 The Contractor shall furnish all documentation required by the Contract <br /> I <br /> and required by law, to allow the City to process final acceptance of the <br /> Contract. <br /> The following documents must be received by the Engineer prior to establishing a <br /> Completion Date: <br /> a. Certified payrolls. <br /> b. Material Acceptance Certification Documents. <br /> I c. Annual Report of Amounts Paid as MBE/WBE Participants. <br /> d. Final Contractor Voucher Certification. <br /> e. Copies of the approved "Affidavit of Prevailing Wages Paid" for the Contractor <br /> I and all Subcontractors. <br /> Supplement 1-08.5 by adding the following: <br /> 1-08.5(2) Substantial vornpietioii <br /> 1 (******) <br /> When the Contractor considers the Work to be Substantially Complete and ready for its <br /> intended use, it shall give Notice to the City's Representative. The Notice shall include <br /> I an itemized list of remaining incomplete Work. If the City's Representative determines <br /> the Work is not substantially complete, it will so notify the Contractor in writing, identifying <br /> the reasons for such a determination. If the City's Representative finds the Work <br /> I <br /> substantially complete, it will meet with the Contractor to (1) prepare a Punch List of <br /> incomplete items of Work; (2) define the division of responsibility between City and <br /> Contractor with respect to security, operation, maintenance, heat, utilities, insurance, <br /> and warranties; and (3) describe other issues related to acceptance of the substantially <br /> Icompleted Work. <br /> If the City's Representative is not an employee of the City, the City's Representative will <br /> write to the City upon reaching agreement with the Contractor, certifying that the Work <br /> I is substantially complete, listing the items of incomplete Work, stating the date for <br /> completion of incomplete work, defining the division of responsibilities, and setting forth <br /> I Cleveland Avenue Division 1 —GENERAL REQUIREMENTS November 2018 <br /> Sewer System Replacement and <br /> Storm Water Separation <br /> IWO No. UP3398 SP -121 <br />
