After due consideration of the testimony and evidence presented by the <br /> Applicant, testimony and evidence elicited during the public hearing, and as the <br /> resuit of the personal inspection of the subject property and surrounding areas <br /> by the Everett Hearing Examiner, the following Findings of Fact and <br /> Conclusions constitute the basis of the decision of the Everett Hearing <br /> Examiner. <br /> FINDINGS OF FACT <br /> 1. The Applicant requested approval from the City of Everett to construct an <br /> 18-foot high, 1,080 square foot detached garage on the property located <br /> at 5606 East Drive, Everett, Washington. It is the intent of the Applicant <br /> to construct this structure in conjunction with the existing house on-site. <br /> (staff report, Ingalsbe testimony) <br /> 2. EMC 19.7.020.H restricts the height of accessory structures within the <br /> Ciry of Evereti to 15 feet, and, EMC 19.7.020.6 limits the square footage <br /> to 1,U00 square feet. Accessory structures must be compatible with <br /> existing dwelling structures on-site, as well as the neighborhood <br /> character. EMC 19.7.020.K permits the Hearing Examiner to give relief <br /> from these standards if there will be no view obstruction, aesthetic <br /> impact on surrounding properties, and no impact to the neighborhood <br /> character. (exhi6it 1) <br /> 3. Exhibit 1 (staff report) includes the ApplicanYs site plan of the proposed <br /> structure. As depicted on the site plan, the pole garage will be <br /> constn�cted on the westem portion of the site. A reduced copy of the site <br /> plan is attached hereto and by this reference is hereby incorporated as <br /> part of these findings. (exhibit 1) <br /> 4. The proposed garage will have a pitched roof that will be consistent with <br /> the single-family residence on-site and the residences to the north and <br /> south. (Ingals6e testimony) <br /> 5. Although the proposed garage will be visible to the property owners to <br /> the north and south, it will be remcved from those structures by more <br /> than 40 feet.
