7. The subject property is 23,250 square feet in area. The residence on- <br /> site is 1,305 square feet. The property exceeds the minimum lot area <br /> criterion, and the 1,080 square foot garage will be less than the area of <br /> the residential struc:ture on-site. (exhibit 1) <br /> S. The Applicant currently has a 96 square foot shed located at the rear <br /> (west) of the location of the proposed garage that he desires to retain. <br /> The Ciry did not object to the retention of the shed. If the square footage <br /> of the shed is included as part of the proposed garage, the total area <br /> would be less than the maximum area allowed for accessory structures. <br /> (exhibit 1, Ingalsbe testimony) <br /> 9. No opposition testimony was submitted at the public hearing. <br /> 10. The City submitted that the Applicant be required to remove or reduce <br /> the 70-foot concrete slab that is currently at the front of the property on <br /> East Drive. The City considers the 70-foot concrete slab as part of the <br /> driveway that exceeds a maximum driveway width of 30 feet as allowed <br /> by the Everett Zoning Code. (Ingalsbe testimony) <br /> 11. The Appficant testified that the concrete slab was constructed in 1989. <br /> (VanNatta testimony) The Everett Zoning Code established width <br /> standards for driveways on January 13, 1990. (Ingalsbe testimony) The <br /> slab may be considered as non-conforming. <br /> 12. The purpose of the concrete slab, as stated by the Applicant, is to allow <br /> an access point for members of his family who are paraplegic. <br /> (VanNatta testimony) <br /> Jurisdiction: The I�earing Examiner of the �ity of Everett has jurisdictional <br /> authority to hold a hearing and to issue the dacision. That authority is set forth <br /> in EMC 2.23.120. Based on the above Findings of Facf, the Hearing Examiner <br /> enters the following Conclusions: <br /> CONCLUSIONS <br /> 1. The Applicant requested approval from the City of Everett to construct an <br /> 18-foot high, 1,080 square foot detached garage on the property located <br /> at 5606 East Drive, Everett, Washington. It is the intent of the Applicant <br /> to construct this structure in conjunction with the existing house on-site. <br /> (finding 1) <br /> 3� <br /> � <br />
