I f Section 5: Billiard Room Closing Hours--Location and Visibility of Facilities . It shall be unlawful for any person owning, managing or having control of any public billiard room, to keep the same open to permit the same to be kept open between the hours of two a.m. and seven a.m. of any day in the week, or to permit any person except any employee to be in such place during said time; provided further, the location of a billiard room for the playing of billiards by the public shall at all times be open and visible from the public street at the street level, and in the event such billiard room or area is not so situated in the building housing such billiard facility, then the location of such billiard room or area in such building shall be approved by the City Clerk, which approval may be withheld by the City Clerk, if such billiard facilites are not open and public within the building, easily accessible, and so located as not to jeopardize the public health, welfare and safety. CHAPTER 5 - CABARETS Section 1 Definitions : (A) Cabaret: "Cabaret" shall mean any room or space whatsoever city of Everett in which any dancing is permitted in connection with the selling, serving or provid- ing the public, with or without charge, liquor. (B) Liquor: "Liquor" shall mean all beverages de- fined in Section 66 . 04 .200 of the Revised Code of Washington. (C) Person: "Person" shall mean one or more natural persons of either sex; firms ; copartnerships and corpora- tions , whether acting by themselves or by servant, agent or employee. Section 2 License Required: It is hereby declared to be unlawful for any person to conduct, manage or operate cabaret dancing unless such person is the holder of a valid and subsisting license from the city of Everett so to do, obtained in the manner herein provided. Section 3 Requirements In Addition To General Requirements : In ad- dition to the general requirements , the following are specific conditions for the license herein; (A) The applicant (s) or manager (s) or owner (s) of the applicant have not been convicted of a crime of moral turpitude or intent to defraud within ten (10) years from the date of application, and, furthermore, has not within ten (10) years from the date of application been released from a penal institution or from active supervision on parole as a result of the conviction of any of the afore- mentioned crimes. (B) The manager or agent of the business must possess the same qualifications required of the license. (C) All the members of a copartnership shall be quali- fied to obtain a license as provided herein.
