CHAPTER 7 - AUCTIONEERS <br /> Section 1 <br /> License--Required: No person shall engage in the business <br /> of auctioneer without a license therefor, issued by the <br /> City of Everett, and such license shall be issued to the <br /> applicant therefor by the City Clerk upon receipt of <br /> the City Treasurer showing payment of the fee required <br /> herein, and such license shall designate the class of <br /> auctioneer, and the time to run. <br /> Section 2 <br /> "Auctioneer"--Defined: Any person selling or attempting <br /> to sell any kind of personal property at public auction <br /> shall be deemed an auctioneer, excepting, however, executive <br /> or other officers selling goods by virtue of any judgment <br /> or decree of any court, and executors , administrators or <br /> hawkers making public sales . <br /> Section 3 <br /> Requirements In Addition To General Provisions : In addition <br /> to the general requirements , there is the additional re- <br /> quirement that the applicant(s) or manager (s) or owner (s) <br /> of the applicant have not been convicted of a crime of <br /> moral turpitude or intent to defraud within ten (10) years <br /> from the date of application, and furthermore, has not <br /> within (10) years from the date of application been <br /> released from a penal institution or from active <br /> supervision or parole as a result of the conviction of <br /> any of the aforementioned crimes . <br /> Section 4 <br /> License Fee: Any auctioneer selling, attempting to sell, <br /> or offering for sale any jewelry consisting of watches , <br /> diamonds , precious stones and all jewelry of gold, silver <br /> or other metal, or anything commonly known as jewelry; <br /> or any clothing, boots , shoes , dry goods , furniture , <br /> household goods of every kind, or any goods , wares or <br /> merchandise not otherwise mentioned herein, and whether <br /> of the kind mentioned herein or not, at public auction <br /> in said City shall pay into the City Treasury a license <br /> fee at the rate of Fifty Dollars ($50 . 00) per day and <br /> procure license therefor upon payment of said license <br /> fee; provided, however, a bona fide charitable non-profit <br /> organization shall be allowed to conduct one auction per <br /> year, for a period not exceeding more than three (3) days , <br /> on the following condition: <br /> A. That the organization is a 'bona fide charitable <br /> non-profit organization' duly existing under the provi- <br /> sions of Chapters 24.12 , 24 . 20 or 24 . 28 RCW, or any non- <br /> profit corporation duly existing under the provisions of <br /> Chapter 24 . 03 RCW for Charitable, benevolent, eleemosynary, <br /> educational, civic purposes only. The fact that contribu- <br /> tions to an organization do not qualify for charitable con- <br /> tribution deduction purposes or that the organization is <br /> not otherwise exempt from payment of federal income taxes <br /> pursuant to the Internal Revenue Code of 1954 , as amended, <br /> shall constitute prima facie evidence that the organiza- <br /> tion is not a bona fide charitable or non-profit organiza- <br /> tion for the purposes of this section. " <br /> B. The auction be conducted by members of a 'bona <br /> fide charitable non-profit organization ' and no person other <br /> than the organization conducting said auction shall receive <br /> any benefit from such auction. <br />
