CHAPTER 7 - AUCTIONEERS Section 1 License--Required: No person shall engage in the business of auctioneer without a license therefor, issued by the City of Everett, and such license shall be issued to the applicant therefor by the City Clerk upon receipt of the City Treasurer showing payment of the fee required herein, and such license shall designate the class of auctioneer, and the time to run. Section 2 "Auctioneer"--Defined: Any person selling or attempting to sell any kind of personal property at public auction shall be deemed an auctioneer, excepting, however, executive or other officers selling goods by virtue of any judgment or decree of any court, and executors , administrators or hawkers making public sales . Section 3 Requirements In Addition To General Provisions : In addition to the general requirements , there is the additional re- quirement that the applicant(s) or manager (s) or owner (s) of the applicant have not been convicted of a crime of moral turpitude or intent to defraud within ten (10) years from the date of application, and furthermore, has not within (10) years from the date of application been released from a penal institution or from active supervision or parole as a result of the conviction of any of the aforementioned crimes . Section 4 License Fee: Any auctioneer selling, attempting to sell, or offering for sale any jewelry consisting of watches , diamonds , precious stones and all jewelry of gold, silver or other metal, or anything commonly known as jewelry; or any clothing, boots , shoes , dry goods , furniture , household goods of every kind, or any goods , wares or merchandise not otherwise mentioned herein, and whether of the kind mentioned herein or not, at public auction in said City shall pay into the City Treasury a license fee at the rate of Fifty Dollars ($50 . 00) per day and procure license therefor upon payment of said license fee; provided, however, a bona fide charitable non-profit organization shall be allowed to conduct one auction per year, for a period not exceeding more than three (3) days , on the following condition: A. That the organization is a 'bona fide charitable non-profit organization' duly existing under the provi- sions of Chapters 24.12 , 24 . 20 or 24 . 28 RCW, or any non- profit corporation duly existing under the provisions of Chapter 24 . 03 RCW for Charitable, benevolent, eleemosynary, educational, civic purposes only. The fact that contribu- tions to an organization do not qualify for charitable con- tribution deduction purposes or that the organization is not otherwise exempt from payment of federal income taxes pursuant to the Internal Revenue Code of 1954 , as amended, shall constitute prima facie evidence that the organiza- tion is not a bona fide charitable or non-profit organiza- tion for the purposes of this section. " B. The auction be conducted by members of a 'bona fide charitable non-profit organization ' and no person other than the organization conducting said auction shall receive any benefit from such auction.
