I <br /> Section 00 21 13 <br /> INSTRUCTIONS TO BIDDERS <br /> 1.7 Bidder's Signature and Authority <br /> The Bid must be signed by a person authorized to sign the Bid on behalf of the Bidder. <br /> 1.8 Revision or Withdrawal of Bid <br /> A Bid may be revised and resubmitted as the official Bid if the City receives the revised bid before the <br /> scheduled time for opening Bids. Resubmitted Bids shall be in full compliance with these Instructions to <br /> Bidders. Bid security shall be in an amount sufficient for the Bid as resubmitted. <br /> After the scheduled time for opening Bids, no Bidder will be permitted to withdraw his Bid unless the <br /> award of contract is delayed for a period exceeding 60 calendar days. Bids received after the scheduled <br /> 1 closing for opening Bids shall be returned to the Bidder unopened. <br /> Within 5 days after the opening of Bids, a Bidder who wishes to claim error after the Bids have been <br /> opened and tabulated shall submit a notarized affidavit signed by the Bidder, accompanied by original <br /> work sheets used in the preparation of the Bid, requesting relief from the responsibilities of award. The <br /> affidavit shall describe the specific error(s) and certify that the work sheets are the originals used in the <br /> preparation of the Bid. The Landscape Architect will review the certified work sheets to determine the <br /> validity of the claimed error and make recommendation to the City. If the City concurs in the claim of <br /> error, the Bidder will be relieved of responsibility, and the bid security of the Bidder will be returned. <br /> Thereafter, at the discretion of the City, all Bids may be rejected or award made to next lowest and <br /> responsive Bidder. At the discretion of the City, Bidders claiming error may or may not be allowed to <br /> ' participate in the re-bid. <br /> 1.9 Bid Security <br /> Bid Security in the amount of at least 5 percent of the Total Bid Amount shall accompany each Bid. This <br /> security may be by certified check, cashier's check, or a bid bond made payable to the City of Everett. A <br /> bid bond shall be on the form provided in the Contract Documents. A bid bond shall not be conditioned <br /> to modify the minimum 5-percent required. <br /> The surety shall: <br /> ' (1) be registered with the Washington State Insurance Commissioner, and <br /> (2)appear on the current Authorized Insurance List in the State of Washington published by the <br /> Office of the Insurance Commissioner. <br /> The failure to furnish a bid security of a minimum of 5 percent shall make the Bid nonresponsive and shall <br /> cause the Bid to be rejected by the City of Everett. <br /> 1 Bid security shall serve as evidence of good faith and as a guarantee that if awarded the Contract the <br /> Bidder will execute the Contract and provide bonds as required by the Bid. Should the successful Bidder <br /> fail to enter into the Contract,furnish a satisfactory performance and payment bond,and furnish evidence <br /> of insurance within 15 calendar days after the award date,the certified check,cashier's check or bid bond <br /> shall be forfeited as liquidated damages. <br /> 1.10 List of Subcontractors <br /> Each Bidder shall submit with its bid a fully completed Section 004336, Proposed Subcontractors Form. <br /> 1.11 Rejection of Any and All Bids <br /> 1 The City reserves the right to reject any and all Bids. <br /> Phil Johnson Ballfields Renovation 3 of 12 <br /> I <br />
