I Section 00 21 13 INSTRUCTIONS TO BIDDERS 1.7 Bidder's Signature and Authority The Bid must be signed by a person authorized to sign the Bid on behalf of the Bidder. 1.8 Revision or Withdrawal of Bid A Bid may be revised and resubmitted as the official Bid if the City receives the revised bid before the scheduled time for opening Bids. Resubmitted Bids shall be in full compliance with these Instructions to Bidders. Bid security shall be in an amount sufficient for the Bid as resubmitted. After the scheduled time for opening Bids, no Bidder will be permitted to withdraw his Bid unless the award of contract is delayed for a period exceeding 60 calendar days. Bids received after the scheduled 1 closing for opening Bids shall be returned to the Bidder unopened. Within 5 days after the opening of Bids, a Bidder who wishes to claim error after the Bids have been opened and tabulated shall submit a notarized affidavit signed by the Bidder, accompanied by original work sheets used in the preparation of the Bid, requesting relief from the responsibilities of award. The affidavit shall describe the specific error(s) and certify that the work sheets are the originals used in the preparation of the Bid. The Landscape Architect will review the certified work sheets to determine the validity of the claimed error and make recommendation to the City. If the City concurs in the claim of error, the Bidder will be relieved of responsibility, and the bid security of the Bidder will be returned. Thereafter, at the discretion of the City, all Bids may be rejected or award made to next lowest and responsive Bidder. At the discretion of the City, Bidders claiming error may or may not be allowed to ' participate in the re-bid. 1.9 Bid Security Bid Security in the amount of at least 5 percent of the Total Bid Amount shall accompany each Bid. This security may be by certified check, cashier's check, or a bid bond made payable to the City of Everett. A bid bond shall be on the form provided in the Contract Documents. A bid bond shall not be conditioned to modify the minimum 5-percent required. The surety shall: ' (1) be registered with the Washington State Insurance Commissioner, and (2)appear on the current Authorized Insurance List in the State of Washington published by the Office of the Insurance Commissioner. The failure to furnish a bid security of a minimum of 5 percent shall make the Bid nonresponsive and shall cause the Bid to be rejected by the City of Everett. 1 Bid security shall serve as evidence of good faith and as a guarantee that if awarded the Contract the Bidder will execute the Contract and provide bonds as required by the Bid. Should the successful Bidder fail to enter into the Contract,furnish a satisfactory performance and payment bond,and furnish evidence of insurance within 15 calendar days after the award date,the certified check,cashier's check or bid bond shall be forfeited as liquidated damages. 1.10 List of Subcontractors Each Bidder shall submit with its bid a fully completed Section 004336, Proposed Subcontractors Form. 1.11 Rejection of Any and All Bids 1 The City reserves the right to reject any and all Bids.
