W <br />BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER VARIANCE NO. 51-87 <br />Based upon the written r->quest for a variance from the City's zoning code by: <br />MGR Partnership <br />17215 Smokey Point Dr. <br />Arlington, WA 98203 <br />hereinafter referred to as "Applicant," for variance from F..M.C.19.24.020 (F) <br />Signs, to allow: <br />A 76 square foot pole sign instead of the 30 square feet allowed by <br />code on the property described in Attachment A, <br />commonly known as: 9505 19th Ave. S.E. <br />The Board of Adjustment, following a public hearing on said application hel <br />on January 4, 1988, and further having reviewed all testimony, makes th <br />following Findings, Conclusions and Order: <br />VARIANCE CRITERIA: <br />Findings and Conclusions: <br />Criterion 41: That there have been exceptional or extraordinary circum', <br />stances or conditions applying to the subject property or as to the intended' <br />use thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />a. Finding #1_ The project site is zoned B-1, Neighborhood <br />Business and the improvements consists of an approximately 20,0001 <br />square foot office building on a 2.3 acre site. <br />The B-1 zone allows one lighted or unlighted free standing or pole sign! <br />30 square feet in area serving a multi -tenanted building on a single, <br />lot. In addition, each separate business establishment is allowed one <br />wall sign or for projecting sign limited to one square foot of signage <br />for each linear foot of the front wall of each business establishment, <br />not to exceed 30 square feet in area. <br />This site is located on a busy arterial street and the properties <br />directly across the street are zoned B-2, Community Business, wnich has <br />no limit on the size or number of signs. Many B-1 zones are located on <br />residential streets and are surrounded by residentially zoned property, <br />which is the reason for the signing restrictions in the 8-1 zone. <br />In addition, the new Comprehensive Plan adopted in 1987 designates this <br />area as Highway Commercial. The former designation was Business/Light <br />Commercial. <br />The applicant does not wish to place separate signs on the front of the[ <br />building itself for each business establishment as the code allows, <br />since the face of the building is stucco and it would spoil the', <br />aesthetics of the building. In addition, the building is set back <br />approximately 160 feet from the street and so the signs on the face of <br />the building would not be effective. <br />Therefore, the applicant wishes to add a six foot by eight foot section <br />to an existing pole sign abutting the 19th Ave. S.E. right of way end <br />list the names of the business establishments on that sign. <br />b. Conclusion #1: There are exceptional circumstances applying t <br />the subject property that do not apply generally to other property i <br />the vicinity. <br />Criterion #2: That such variance is necessary for the preservation and en <br />joyment of a substantial property right of the appellant pos sessed by the <br />owners of othar properties in the same vicinity or zone. <br />a. Finding: Since the property is located directly across the street <br />from an area zoned B-2, where there is no limit on height or size of <br />
